Prosecutors dropped charges against a Henrico man arrested outside of an FBI office after he refused to speak to an officer.

The charge against Kyle Hammond have been dismissed with prejudice, meaning he will not be prosecuted and the charge cannot be brought back at a future time.

Hammond claims he was taken to jail for refusing to talk to an officer as he filmed his own arrest. We sat down with the man who filmed the video last week.

"What did you feel when all of this was going on?" we asked Kyle.

"I was actually really surprised," he said. Kyle had been taking pictures outside the FBI building when the officer approached. "I went from being detained to arrested in less than a second. And you don't have to talk to the cops."
