RICHMOND, VA (WWBT) - Mark Obenshain will officially request a recount in Virginia's Attorney General's race, his campaign announced Tuesday.
Obenshain will file the request Wednesday morning in the tight race. He trails Mark Herring by just 165 votes out of more than 2.2 million cast in the November election.
Recounts must be supervised by a three-judge court in Richmond, according to Virginia code.
Legislation sponsored by Senator Creigh Deeds was enacted in 2008, which mandates optical scan ballots be run through machines and re-tabulated, with any ballot rejected by the optical scan machine to be counted by hand.
