ALBEMARLE, VA (WWBT) - A judge has denied the motion from Jesse Matthew's defense to suppress key evidence in the Hannah Graham murder trial, according to NBC29.
Matthew's attorneys argued that evidence collected at his apartment were not within the permissible scope of the search warrant. Some of the evidence included a Samsung phone, a paycheck, Khaki shorts, boxer shorts, a cigar tip, toothbrushes, a wallet and a receipt.
Judge Higgins denied the defense's motion around 1 p.m. on Thursday.
Last week, the defense tried to argue that investigators' affidavit for the warrant was intentionally misleading, and that key pieces of evidence were omitted.
