HENRICO, VA (WWBT) -

A case involving former Delegate Joe Morrissey heads to court Monday morning.

The Virginia Court of Appeals has granted prosecutors' request for a hearing on a lower court's dismissal of Morrissey's felony charges.

Back in April, a Henrico judge dismissed all felony charges in a perjury and forgery case against the former delegate. However, the state appealed the case and their request was granted.

The hearing is scheduled for 11 a.m.

Morrissey recently withdrew from the State Senate race due to health issues.
