CHARLES CITY, VA (WWBT) - Delvin Barnes is no longer facing charges in a brutal Charles City County abduction and rape case.
The Commonwealth Attorney decided to nolle pros the case against Barnes on Wednesday, meaning the charges are dropped but can be refiled in the future. Despite the procedural move, Barnes will remain in federal custody as he faces a kidnapping charge in the case of a Philadelphia woman grabbed off a street corner on November 2.
Authorities say Barnes took Carlesha Freeland-Gaither to Maryland, where she was eventually rescued with the help of Central Virginia sheriffs. If convicted, Barnes could face up to life in prison in that case.

The Charles City County case involves the kidnapping of a 16-year-old Richmond girl in October. Authorities say Barnes hit the girl in the head with a shovel, forced her into the trunk of his car, and brought her to his Charles City County home. Deputies believe he raped the teen, then poured bleach and gasoline on her and was digging her grave when she managed to escape and run to safety two days later.
