Virginia files notice of appeal against same-sex marriage ruling

RICHMOND, VA (WWBT) - The Commonwealth of Virginia has filed a notice of appeal following a ruling against Virginia's same-sex marriage ban.

Attorney General Mark Herring said he filed the notice to help expedite the appeals process.

"Throughout this process I have maintained that the law requires equal treatment for same-sex couples," said Attorney General Herring. "Although the court agreed with the Commonwealth's position that the state's ban on same-sex marriage is unconstitutional, I have filed a notice of appeal to ensure that higher courts can swiftly rule on the critical issues in this case, consistent with my commitment to the rule of law."

U.S. District Judge Arenda Wright Allen ruled the ban on gay marriage to be unconstitutional on February 13. The couple in the case of Bostic v. Rainey said they were "extremely grateful".

The schedule for the appeal is under development.
