Judge denies request for special prosecutor in Rusty Mack case

COLONIAL HEIGHTS, VA (WWBT) -

A judge denied a request from Colonial Heights' Commonwealth's Attorney for a special prosecutor in the Rusty Mack case.

William Bray requested the special prosecutor for the only remaining trial in the beating death of Rusty Mack, after getting harsh criticism from the community over acquittals and dropped charges against the three other defendants in the murder by mob case.

The judge denied the request, but said he would allow a prosecutor to be brought in to work with Bray on the trial.

The motion was filed Thursday after Assistant Commonwealth Attorney Elizabeth Fields left the office saying on Facebook to a closed group page with Rusty Mack supporters that she felt Bray should have offered text messages and autopsy photos as evidence in the cases.

The lone remaining defendant, Margaret Blair Dacey, is due in court early next year. She is facing murder and felony assault charges.
