Parents, brother of Amelia boy shot in face charged

AMELIA, VA (WWBT) -

There's a brand new twist in the shooting investigation of an 11 year old Amelia boy - now recovering after being shot in the face. Monday, investigators said they're also charging the boy's 10 year old brother in connection with that accidental shooting.

Before and after court Monday the victim's parents went through extreme measures to make sure their faces avoided television cameras. That's because their 10 year old son was with them and he's facing charges too.

"Is it difficult to formally charge a child?" NBC 12 asked Commonwealth Attorney Lee Harrison.

"Not really. We look at the facts and we charge whoever needs to be charged," Harrison said.

The 10 year old is charged with misdemeanor reckless handling of a gun. His parents, Patrick and Joanna Callaway, are charged with felony child endangerment. According to the Amelia Bulletin Monitor, the two were not home at the time of the shooting.

"I would hope that parents who have firearms in their home will look at this situation and re-evaluate how they store their firearms at their home…secured so that the child or children will not have access to them," Harrison said.

Investigators say the little boy's condition is steadily improving.

"The teachers had got us in a big group and telling us about how he got shot and to stay away from guns," said student Raheim Jasper who goes to school with the 11 year old.

He says his classmates made cards and are all pulling for his full recovery.

"I think it's hard to get shot at an early age, to have to go through all that surgery and stuff…my heart goes out to him and I feel sorry for him," Jasper said.

Now, two parents and their own child prepare to fight the criminal charges against them.

"It's very sensitive it involves a family and a tragedy that occurred within that family," Harrison said.

The Callaways return to court on January 13th. The shooting happened on October 17 at a home on Oak Grove Loop. Police say the 10-year-old and his 11-year-old brother were playing with a gun when it fired. The bullet struck the 11-year-old in the face. He was taken to the hospital by Med Flight where he is recovering.
