Chicopee man on trial for assaulting officer


Testimony continued Thursday in Hampden Superior Court for the Chicopee man accused of assaulting a police officer.

Jay DiRico is accused of assaulted Officer Jeffrey Couture at DiRico's home back in April of 2012. 

He is facing several charges including assault with attempt to murder and assault and battery of a police officer.

Couture was responding to a keeping the peace call at the time of the incident. He says DiRico's estranged girlfriend Corrine Nelson called police to ask for help in getting her belongings.

The prosecution says while Couture was at the home, DiRico went after Nelson. Couture says when he stepped in to protect her, DiRico started to attack him.

The defense contends Couture harassed DiRico. DiRico's attorneys say he was the resident of the home and that Couture had no right to enter. 

Thursday's testimony began with the defense cross-examining the officer.

During a part of that testimony there was an incident where in response to a question by the defense, Couture said something like, I don't remember if he (DiRico) testifies he can tell you. The judge gave jurors specific instructions to disregard that statement.

"It is absolutely crucial that you not consider in any way shape or form the comment that was made by the witness concerning Mr. DiRico's opportunity to testify or not," said Judge Bertha Josephson.

The second witness to take to the stand was Nelson.
