A man accused of killing a neighbor in Lakeside over loud dirt bikes will go on trial Tuesday.
24-year-old Michael Mabry is accused of shooting his 62-year-old neighbor, Donald Sims.
Sims was angry and had been for years about dirt bike noise in his neighborhood, according to police and witnesses. He thought Mabry was one of the people responsible. The two had an argument, and neighbors saw Mabry shoot the victim.
The defense has said that right before the fatal gunshot, the victim had a civil war sword and a gun drawn, which is expected to lead to a self defense argument.
Jury selection begins Tuesday. The suspect will stay in jail for the entire trial, where he's been for almost six months.
