Bus driver files lawsuit following attack

RICHMOND, VA (WWBT) -

A former Richmond City School bus driver is filing a lawsuit against the school board. 55-year-old Gregory Davis was fired after police say a group of middle schoolers attacked him.  

He was driving them to Albert Hill Middle School back in November. NBC12 dug through court documents and even caught up with Davis outside his home.   

"I'm doing terrible," said Davis. "I'm not going to make any more statements. I'm finished with that. I'm dealing with that because that's just the way it is. I'm not trying to be hateful or anything like that. It's terrible. That's all I can say. It's terrible."

Davis' attorney, William Seymour, says the school system let him go unfairly. 

"He's assaulted, injured, placed on leave without pay, and no one communicates with him for two months, then he receives a letter in the mail and told he's terminated - obviously not a very pleasant experience for anybody." 

That experience erupted back in November when Davis claimed several students attacked him while he was driving the bus, but the violence peaked at Idlewood avenue and Sheppard street.  

It was at this stop where one student approached Davis on the bus and punched him. According to the complaint, several other students joined in on the assault. 

They were charged, but Davis was the one who got fired. In a letter to Davis, the school system said it based its decision on Virginia code that states public school employees may be suspended if the safety and welfare of the school or students is threatened - but Davis was never charged. There's a long list of complaints filed for students on his bus. 

We contacted a spokesperson with the school system. She could not comment on camera regarding pending litigation.  

Davis' attorney is asking to restore his pay and give him a hearing before the board to resolve these matters. The students are still scheduled to go on trial April 17.
