
A federal appeals court says a lawsuit brought against federal officials by the man who stripped down to his boxers at Richmond International can move forward.
Aaron Tobey stripped at the airport's checkpoint in 2011, to protest security procedures.
After his arrest, he sued - claiming TSA officers violated his first amendment right of free speech.
One judge on the federal panel said bizarre, non destructive speech is still protected under the first amendment.
The attorneys representing Tobey called Friday's decision a rare victory.
