Case against Henrico teen withdrawn

HENRICO, VA (WWBT) -

Charges were dropped against the Henrico teenager accused of shooting a girl in the head. Marcus Moore, 19, and his family are now breathing a sigh of relief. Moore had been on house arrest since September, facing two felony charges including malicious wounding, after a West End party turned violent.

Deputy Commonwealth Attorney Nancy Oglesby says that a second ballistic report shows that there were two guns that went off outside the party back in September. Charges have subsequently been dropped against Moore.

After a court appearance Tuesday morning, Moore has been released from house arrest and can return to a normal life.

Back in September, when Moore learned of a warrant out for his arrest, he turned himself into police. Moore has always insisted that he's not the one who pulled the trigger outside a Henrico House party. A bullet pierced a 17-year-old girl from Hanover in the head.

Moore spoke to NBC12 upon going under house arrest.

"I put it in god's hands. I'm stressing over it, but at the end of the day, I know the lord is going to look out," said Moore during an interview in September.

Tuesday, those prayers were answered. Moore's mother Germaine Raines says she felt overwhelming emotions in court after hearing the case would be withdrawn.

"I went through so many emotions," said Raines. "I can't even really explain it. But it still hasn't sunk in."

Raines says the looming charges against her son impacted everyone close to him.

"It's just been stressful. It's been emotionally draining, for the whole family," continued Raines.

She says the house arrest also drained their family financially. "$70 dollars a week for an ankle bracelet; that was really tough."

However now, tough times have seemingly come to an end. Marcus no longer faces pending charges that could severely cripple his future, if convicted.

"I had my Christmas present today…When you know the accusations against you are wrong, you have to have faith in God," said Raines.

Commonwealth attorneys say the charges against Moore are technically nolle prosequi, which means they can bring back charges at any time. Oglesby says Moore is still a person of interest.

    A woman has died, after police say she was struck by a van in Richmond. The driver of that van stayed on the scene. Police say the woman was already dead when they got to the scene. The driver is not facing charges at this time.
