12 INVESTIGATES: Settlement offered in VCU Dentistry death case

HENRICO, VA (WWBT) -

The state has agreed to pay the family of a Henrico County boy who died shortly after a dental procedure at VCU $100,000.

6-year-old Jacobi Hill went into cardiac arrest at the VCU School of Dentistry and was rushed to the hospital in May of 2010.

His mother has never been able to reconcile what happened.

"I want to know what happened to my child. I need answers," said Crystal Lewis.

Jacobi Hill had asthma, but no other known health problems when he was taken to VCU's dental clinic for a procedure.

He was sedated, but soon afterward ended up in the ER.

"He was just going to get caps put on his teeth and while he was there he went into cardiac arrest," said Jacobi's grandmother Carolyn Suggs. "They worked on him and worked on him to try to revive him but they lost him."

The medical examiner ruled hill died of natural causes, saying the boy had an irregular heartbeat caused when his breathing tube was removed.

The family never accepted those findings and filed suit, alleging the dentist, his nurses and the medical center negligently diagnosed, treated and cared for Hill.

The Commonwealth denies it's liable for the death, but Ken Cuccinelli's office has agreed to pay Jacobi's family $100,000. There's a hearing scheduled for next week. A Richmond judge will decide whether to approve the settlement.

The family is also suing the dentist who was working on Jacobi's teeth before he died. There was supposed to be a hearing in that case next week - but it's been continued.
