CHARLOTTESVILLE, VA (AP/WWBT) - George Huguely will be back in court on Tuesday.
Defense lawyers are asking a judge to investigate whether prosecutors withheld information that Yeardley Love's family planned to file a civil suit.
Yeardley love's mother, Sharon, is looking for $30.5 million in a wrongful death suit.
The defense wants a new trial after it says Commonwealth's attorney, Dave Chapman, withheld evidence. They say Chapman didn't tell them Love's family planned to file a civil suit before they took the stand in the murder trial.
Huguely's attorneys say if they had known, they would have tried to discredit the testimony of Love's mother and sister. The prosecution is denying any impropriety in its handling of this case.
A judge recently denied requests for cameras in the courtroom for Huguely's criminal proceedings. He is scheduled to be sentenced for Love's murder August 30.
