RPD gets support from Cuccinelli in OT lawsuit

RICHMOND, VA (WWBT) - Richmond Police officers fighting for unpaid overtime got a strong show of support from Virginia's Attorney General.

Ken Cuccinelli filed a 13-page memorandum Friday supporting the 500 active and retired officers currently suing the City claiming they were not fully paid for overtime they worked. The memorandum cites a 4th U.S. Circuit Court of Appeals decision which upheld the authority of states to enact laws that provide wage and overtime compensation beyond the minimum in the fair labor standards act.

Richmond faces a $38 million liability and is asking Judge Henry Hudson to dismiss the suit. Henrico County has also been sued by 90 current and retired officers.
