HENRICO, VA (WWBT) - Henrico police officers who shot and killed a robbery suspect have been cleared of any wrongdoing.
It was self-defense. That finding from Henrico Commonwealth's Attorney Wade Kizer.
In late July, police say Basil Berry was one of two men who robbed a Williamsburg-area jewelry store, then fled in a car, toward Henrico County.
Two separate times, authorities say Berry encountered Henrico police officers, and fired at them first.
The officers returned fire, and authorities later said he died of bullet wounds the head and chest.
An alleged accomplice, Eric Roach, hid from police for three more days before being caught on area railroad tracks.
Roach remains in jail, now facing robbery and eluding police charges in Williamsburg and Henrico.
Meanwhile, the three officers who shot Berry were on paid leave since July, but they're back on the job tonight. Their names were not released.
