HENRICO, VA (WWBT) - A Henrico mother is accused of driving drunk, and leaving her children home alone.
26-year-old Beatriz Martinez faces several charges after police say she was behind the wheel while drunk, and crashed her car. Monday morning she appeared in court by video conference to face a judge. Martinez was given a trial date and a court appointed attorney.
Martinez is charged with DUI, driving on a revoked or suspended licence and four counts of contributing to the delinquency of a minor.
It was Sunday, around 1:20 a.m. when officers responded to a vehicle crash at Staples Mill Road and Glenside Drive.
Officers say, Martinez was behind the wheel. According to court records Martinez was unsteady on her feet and her eyes were red and watery.
Martinez told the officer she had 3 beers. Court records indicate her blood alcohol level was three times the legal limit .247.
According to police Martinez told an officer her 4 young children were home alone - not far from the crash scene. Investigators found the children, ages 2 to 10, inside the home.
A neighbor calls the situation alarming.
"It's terrible -- a bunch a kids would be stuck on their own like that," said neighbor, William Spooner.
Spooner says he's seen the young mother's children playing in the neighborhood.
"Normally just running around on their bike - just playing around -- having a good time," he added.
It's unclear how long the children were home alone.
Martinez has faced similar charges in the past. In 2009 she was convicted of driving without a license. In July of this year -- she was found guilty of being intoxicated in public and was ordered to pay a $50 fine and court cost.
This most recent DUI arrest is the 2nd for Martinez in five years.
Child protective services took Martinez' children. They're now staying with relatives.
Martinez is scheduled to go on trial in December.
