RICHMOND, VA (WWBT) - Virginia isn't taking no for an answer. The state attorney general wants the U.S. Supreme Court to consider his challenge to President Obama's healthcare overhaul.
Ken Cuccinelli promised he would file the appeal, and Friday, he did just that. Back in September, the U.S. Circuit Court of Appeals unanimously dismissed Cuccinelli's lawsuit, ruling that Virginia lacked legal standing to file the complaint.
The court did not rule on the core issue of the constitutionality of the law's requirement that individuals buy health insurance or pay a penalty starting 2014.
The Obama administration already has appealed to the supreme a ruling by a federal appeals court in Atlanta that struck down the insurance mandate.
