CHESTERFIELD, VA (WWBT) - A man accused of attempting to spread the HIV virus appears before a judge today in Chesterfield County.
Andre Harvin is accused of having sex with a 14-year-old girl -- knowing full well that he could infect her with the virus.
Harvin waived his right to a preliminary hearing, that means his case will head to the grand jury for indictment.
Harvin was arrested in May. He is facing two felony charges, including carnal knowledge of a 14-year-old girl and sexual battery with the intent to spread infection.
The arrest warrant claims that Harvin knew he had HIV and wanted to spread the disease to the girl. The girl has not been identified.
Prosecutors allege that Harvin is HIV positive. The girl has not been tested for the disease. She has to request to be tested and chose not to do that at this point.
The grand jury meets again in September. Harvin is in jail.
