RICHMOND, VA (WWBT) - There could be a delay in the case against a Chesterfield mother charged with murdering her baby.

According to prosecutors, the attorney for 24-year old Robin Varner filed motions relating to her competency. That will delay the preliminary hearing that was set for later today.

Varner is charged with second degree murder for the death of her 5-month old baby Josephine Lee, back in January.

The Chesterfield mom could get up to 40 years in prison, if convicted.
