RICHMOND, VA (WWBT) - A judge's ruling that the City of Richmond's noise ordinance is unconstitutional will stand.
Today at 2 p.m. was the deadline for the city to appeal the decision, and nothing was filed.
The judge ruled on November 30 that the ordinance was too broad and unconstitutionally promotes religion. The decision came in a case involving music played by a band at a house party.
The charges were dismissed this afternoon against the members of that band.
The city is already working on drafting a new ordinance.
