RICHMOND, VA (WWBT) - A Richmond band, cited under the city's new noise ordinance could have had the charges against them dropped today, but asked the judge not to.
The city attorney's office was not ready for this major challenge to the city's noise ordinance today and asked the judge for a continuance.
Judge Phillip Hairston was upset and said he would dismiss the charges, but the band, Little Master, said no. Members of the band said they want to know if the city's noise ordinance is constitutional.
The city attorney's office declined to comment for our story, but told the judge in court the city does not believe the new ordinance is unconstitutional, and plans to fight this challenge.
Judge Hairston will hear both sides October 18 in the Manchester courthouse.
