Grandmother will not see jail time in 5 year old's death

RICHMOND, VA (WWBT) - A Richmond grandmother convicted of child neglect in connection with the death of a 5 year old, will not serve any jail time.

This morning a judge suspended Judy Wright's jury recommended, two year prison sentence.

Wright's 10-year-old son found a loaded handgun inside a gym bag and shot and killed her 5 year old granddaughter, Dominique Carter.

Wright was watching the children, but had left her Church Hill home to go to work.

Wright's attorney maintains Wright did not know the gun was in the gym bag.

Prosecutors say the boy had a history of violent and disturbing behavior.

This morning the judge accepted the jury's two year sentence, but then suspended it.  She remains under court supervised probation.
