Richmond police officers indicted in alleged nightclub assault

RICHMOND, VA (WWBT) - A special prosecutor will be brought in to handle the case against two Richmond police officers accused of assault and battery.

Charles Battle and Donnell Patterson were each indicted by a grand jury this week on the misdemeanor charge.

The pair are accused of throwing an 18 year old to the ground and kicking and beating him.

It happened on July 27, 2009, outside of Club 534 where the officers were off duty but working as security.

According to published reports, additional police showed up to manage a potentially hostile situation. The victim says he was never in the club that night and he was only hanging out nearby when he says he was thrown to the ground and beat up by police.

The defense attorney for Battle says he's a 15-year veteran and she says the charges are based on bad evidence. She plans to ask for a jury trial.

Battle and Patterson were both arraigned in court Thursday morning and released on bond.
