RICHMOND, VA (WWBT) - The case against a Virginia Union student accused of killing an alleged thief is headed to a grand jury.
It happened in the Union Hill neighborhood of east Richmond in April. Police say Eric Driver shot and killed a man breaking into his girlfriend's car.
On April 22, Union Hill resident Dan Manza was walking his dogs a nearby this alley. From this viewpoint he says he heard to gun shots and then saw a man running and another chasing with a gun.
In all, witnesses say 25-year-old Eric Driver fired at least 6 shots at 24-year-old Jamal Hollman. We learned today, Hollman was hit three times.
Driver's attorney says today's witnesses did not see the whole encounter. Driver told police he thought Hollman had a gun.
But prosecutor's tell a different story. They say Driver put the public at risk and had no legal right to shoot at Hollman.
